The basis on which we provide buyer-side property services: scope, fees in euro, cancellation, liability and complaints.
These terms
These terms apply to the services provided by DAHAB ESTATES LTD (company number 16409290), registered in England and Wales. They sit alongside the written engagement that sets out the scope and the fee for your particular purchase. Where the two differ, the engagement letter applies.
Scope of the service
We act for the buyer. Our work may include property search, viewings, negotiation support, coordination of the legal and mortgage process and relocation support, as set out in the engagement.
We are not an estate agent, we do not market or sell property, and we do not receive a commission from a seller, developer or agent on a property you buy through us.
What we do not provide
We do not provide legal, tax, immigration or surveying advice, and we do not act as your solicitor, your lender or your surveyor. Those services must be instructed separately by you.
We do not guarantee that a purchase will complete, that an offer will be accepted, that a mortgage will be approved, or that a property will prove suitable after you have bought it. Decisions about a property are yours.
Fees and payment
The fee for an engagement is agreed in writing before work begins and is stated in euro. It is based on the scope you ask for, not on the price of the property.
Unless the engagement says otherwise, the fee is payable in the instalments set out there. Third-party costs — searches, surveys, legal fees, removals — are payable by you to the provider concerned and are not included in our fee.
Cancellation and rescheduling
You may end an engagement at any time in writing. Where work has already been carried out, you pay for the part completed; any amount paid in advance for work not yet done is returned.
Viewing appointments can be rescheduled. Selling agents set their own access conditions, so a confirmed appointment can still be moved by the occupier at short notice; we tell you as soon as we know.
Nothing in this clause affects statutory rights you have as a consumer.
Liability
We carry out our work with reasonable care and skill. We are not liable for losses caused by decisions you take against our written advice, by information supplied to us by others (agents, solicitors, lenders or search providers) that proves inaccurate, or for indirect or consequential loss.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Complaints
If something has gone wrong, tell us first: write to info@dahabestates.co.uk with the details and we will respond in writing. We will set out what we have done, what we propose to do, and by when. If the matter cannot be resolved between us, we will tell you which redress scheme or regulator, if any, applies to the service concerned.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
